Uncontested divorce lawyers in edmonton

When everything is resolved between you, the final step must meet Alberta Court requirements. We prepare and file your divorce correctly, and manage the process until your Divorce Judgment is issued — so it is finalized without avoidable delay or rejection.

what we need from you - and what we handle

An uncontested divorce works when the major issues are already resolved. That could mean you have a written agreement. It could mean you and your spouse have agreed on everything but never formally documented it. It could mean there are no children or property issues left to divide. In some cases, it means the other spouse is unresponsive.

If the core issues are resolved, we take over the legal process.

We prepare the required Court documents, ensure affidavits are properly sworn, confirm service requirements are met, file through the Court of King’s Bench, respond to clerk requisitions if they arise, and move the file through to Divorce Judgment.

This is a defined flat-fee process provided the issues are resolved. If new disputes surface, we address that directly before anything expands.

uncontested does not mean automatic

this is a procedural process - not just a form

Even when both spouses agree, the Alberta divorce process is technical. The Court does not rubber stamp uncontested files. Materials must meet procedural requirements or they are sent back.

We ensure:

  • Affidavits are complete and compliant
  • Service is handled properly
  • Required documents are included at filing
  • Clerk requisitions are addressed quickly and accurately

The goal is simple: get the Divorce Judgment issued properly and without delay.

Frequently Asked Questions

How long does an uncontested divorce take?

Court timelines vary, but as a general guide: filing the Statement of Claim for Divorce typically takes 3–5 weeks. Filing the remaining required materials often takes an additional 3–6 weeks, depending on preparation and Court processing times. Once submitted, receiving the filed Divorce Judgment usually takes another 3–6 weeks.

These timelines depend on Court volume and whether materials are accepted without correction.

Do we both have to attend Court?

In most uncontested matters, no in-person Court attendance is required. The process is handled through written materials submitted to the Court.

What if my spouse will not respond?

If the other spouse is unresponsive, the divorce may still proceed provided proper service requirements are met. We assess that during the consultation.

Is this really flat-fee?

Yes, provided the issues are resolved and the matter qualifies as uncontested. If new disputes arise, we explain the implications before any expansion of scope.

What happens after I book the consultation?

You will receive confirmation of your appointment. During the consultation, we confirm eligibility for an uncontested divorce and outline the exact next steps.
